Have you just recently been convicted of a crime in Michigan that you are seeking to overturn on appeal?

Are you looking for justice and a second chance?

A criminal conviction is a lot of weight to bear and can alter more than one person’s life.

Seeking counsel from an experienced criminal appellate attorney early on provides the optimal opportunity for proactive advice, ensuring the best chance of achieving a favorable result.

As a lawyer with a strong commitment to justice and a deep understanding of Michigan’s legal system, let Mark Linton be your ally in pursuing a successful criminal appeal.

Appeals can be based on:

- New Evidence

- An Unfair Trial

- Ineffective Representation

- A Sentence Outside of the Michigan Sentencing Guidelines

We can assist with the appeal process at all court levels, from district to circuit court, all the way up to the Michigan Court of Appeals and the Michigan Supreme Court.

We assist with both an "Appeal of Right" or an "Application for Leave to Appeal".

6500 MOTIONS

When you have exhausted your initial appellate rights to overturn a criminal conviction, another option is available.

A 6500 motion applies when the appeal of right process is exhausted and you are seeking a new avenue to overturn a criminal conviction. A 6500 motion allows you to address issues, including new evidence not raised during a trial or the appeal of right process.

Please note that you may only have one opportunity to file a 6500 motion, so it is imperative that it be done correctly the first time.

Your new evidence must be solid and supported and can be in the form of new physical evidence or witness testimony presented to the court in the form of an affidavit.

  • An appeal is a way to ask the Michigan Court of Appeals to correct an error that was made by a Michigan Circuit Court. When seeking an appeal, you must be familiar with the time limitations set forth in the Michigan Court Rules governing cases brought before the Michigan Court of Appeals. Those limitations are strictly enforced by the Court. The Michigan Court of Appeals is a busy tribunal, receiving thousands of cases a year and addressing them with ever-decreasing resources. A late filing will be rejected. A rejection denies the appellant the relief to which they may have been entitled. The appeal process is generally started by filing a claim of appeal or an application for leave to appeal, depending on the type of appeal being filed.
